1. Definitions

• "User" means any individual who accesses or uses the Services, including property owners, managers, staff, and tenants.
• "Property Owner" means a user who creates or administers a property on the platform.
• "Tenant" means a user enrolled or associated with a property for accommodation or related services.
• "Property Data" means information entered into the platform relating to a property, its rooms, tenants, finances, and operations.
• "User Content" means data, text, files, images, and other materials submitted to the Services by users.

2. Eligibility

• You must be at least 18 years old and capable of entering into a binding contract under applicable law.
• You must provide accurate registration information and maintain the security of your account credentials and device.
• You may use the Services only in compliance with these Terms and all applicable laws and regulations in India.

3. Description of Services

EasyAavaas provides cloud-based software for PG, co-living, and related property operators to manage tenants, rooms, rent records, utility bills, complaints, operational requests, visitors, announcements, inventory, team permissions, and notifications.

We may add, modify, or discontinue features at any time. Beta or "coming soon" features may be offered on an as-is basis and may change without notice.

EasyAavaas is a software platform only. We do not provide accommodation, act as a landlord, broker, or payment intermediary between property owners and tenants unless explicitly stated in a separate written agreement.

4. Account Registration and Security

• Access requires registration using a valid Indian mobile number and OTP verification, unless we permit alternative methods.
• You are responsible for all activity under your account and for promptly notifying us of unauthorized access at [email protected].
• We may suspend or terminate accounts that violate these Terms, pose security risks, or are inactive for extended periods, subject to applicable law.
• You may not share OTP codes, impersonate another person, or create accounts using false information.

5. User Roles and Responsibilities

Different roles have different permissions within the platform:

• Property Owners are responsible for accurate property setup, lawful collection of tenant information, staff authorization, and compliance with rental, housing, and data protection laws applicable to their operations.
• Managers and Staff may access only the modules and actions granted by the Property Owner through role defaults or permission overrides.
• Tenants may use permitted features such as viewing rent records, submitting payment proofs, filing complaints, and submitting operational requests.

Property Owners and authorized staff act on their own behalf when managing tenant relationships, rent collection, refunds, deposits, agreements, and house rules. EasyAavaas does not supervise or guarantee their conduct.

6. Acceptable Use

You agree not to:

• Use the Services for unlawful, fraudulent, harassing, discriminatory, or abusive purposes.
• Upload malware, attempt unauthorized access, reverse engineer, scrape, or interfere with the integrity or performance of the Services.
• Upload content that infringes intellectual property, privacy, or other rights of third parties.
• Misrepresent your identity, role, or affiliation with a property.
• Use the Services to store or transmit content prohibited by law, including content that is defamatory, obscene, or threatening.
• Circumvent permission controls or access data belonging to properties you are not authorized to manage.

We may investigate violations and cooperate with law enforcement. We may remove content or restrict access where we reasonably believe a violation has occurred.

7. User Content and Property Data

You retain ownership of User Content you submit. By submitting User Content, you grant EasyAavaas a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, and transmit such content solely to operate, improve, and secure the Services and as otherwise described in our Privacy Policy.

Property Owners represent that they have all necessary rights, consents, and legal bases to collect and upload tenant and operational data to the platform, including identity documents and emergency contacts.

We are not obligated to monitor all User Content but may do so to enforce these Terms or comply with law.

8. Rent, Payments, and Financial Records

The platform may allow tenants to submit rent payment details and proof, and allow owners or staff to record or verify payments. Unless explicitly stated otherwise, EasyAavaas does not process bank transfers, UPI settlements, or card payments on behalf of users and is not a payment gateway, bank, or money transmitter.

• Financial amounts, due dates, penalties, and utility allocations displayed in the app are based on data entered or configured by property operators.
• Disputes regarding rent, deposits, refunds, or deductions are primarily between tenants and property owners. EasyAavaas may provide records to assist resolution but is not liable for billing errors caused by user input or property policies.
• Any future paid subscription or platform fees charged by EasyAavaas will be subject to separate pricing terms announced at that time.

9. Intellectual Property

The Services, including software, design, logos, trademarks, documentation, and underlying technology, are owned by EasyAavaas or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

You may not copy, modify, distribute, sell, or lease any part of the Services or included software without our prior written consent.

10. Third-Party Services

The Services may integrate third-party services such as cloud hosting, OTP delivery, push notifications, analytics, or file storage. Your use of third-party services may be subject to their separate terms and privacy policies. We are not responsible for third-party services.

11. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASYAAVAAS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that data entered by users will be accurate or complete.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EASYAAVAAS AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO EASYAAVAAS FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) INR 5,000.

Some jurisdictions do not allow certain limitations of liability; in such cases, our liability is limited to the fullest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless EasyAavaas and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your User Content or Property Data; (c) your violation of these Terms or applicable law; or (d) your relationship with tenants, staff, or other users.

14. Suspension and Termination

We may suspend or terminate your access to the Services immediately if you breach these Terms, if required by law, or if continued access poses a security or legal risk. You may stop using the Services at any time.

Upon termination, your right to access the Services ceases. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

Before initiating formal proceedings, the parties agree to attempt to resolve disputes in good faith by contacting [email protected].

Subject to applicable law, courts at Gurugram, Haryana, India shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.

16. Changes to These Terms

We may modify these Terms at any time. Material changes will be posted on this page with an updated effective date. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Services.
